This Privacy Policy regulates the website www.gomins.es, use, the Web hereinafter. When accessing and using the Web you acknowledge you have read and agreed the Privacy Policy binding yourself to comply with its terms and conditions.

Through the Web, ÁLAVA REYES intends to promote activities of their own, including, but not limited to, logging in the Web, participating in the activities included in it and providing you information regarding ÁLAVA REYES and GOMINS (videogame and parents’ application) activities, as well as other AR&D and Research and Development department from Álava Reyes Group products.

ÁLAVA REYES reserves the right to amend the Web and its contents presentation, configuration and location at any time.

You acknowledge and agree you access and use this Web willingly and consciously, under your own responsability only. ÁLAVA REYES won’t take responsability of the use you can give to the Web, neither of the consequential damages derived from such, under any circumstances.

You bind yourself to give an appropriate and legitimate use to the Web and its contents, according to the applicable legislation and the Web Terms and Conditions of Use.

Intellectual and Industrial Property Rights

You acknowledge and agree that all intellectual and industrial property rights over the Contents and/or any other elements incorporated in the Web, might be owned by ÁLAVA REYES.

Regarding the Contents or any other elements incorporated in the Web whose intellectual and industrial property rights are owned by ÁLAVA REYES and/or third parties, you acknowledge and agree that any use is strictly prohibited, as well as their reproduction, public communication and/or distribution, modification, alteration or decompiling, be it for personal , private and non-profit use ends or commercial or lucrative ends, unless otherwise stated.

The Web might include links and search engines which allow users to access third parties websites. These elements will be provided for reference only. In any case, users are advised to check third parties websites terms and conditions of use and privacy policies, when they access through the links included in the Web.

Although ÁLAVA REYES previously review the contents of those websites with which a link is established, and only provides links to those websites which, to the best of its knowledge, comply with the applicable legislation, ÁLAVA REYES doesn’t approve or control such websites’ contents or any modifications in the same, and expressly excludes any liability for any damage arising from the access, use or inability to use any website or its contents with which a link is established.

Without limiting the foregoing, ÁLAVA REYES reserves the rights to remove the links to any website in case it is effectively acquainted that the activities developed in the website or its contents are illegal or infringe the rights of third parties, or when requested to do so under a judicial decission or an administrative instruction.

Exclusion and guarantees of responsibility

ÁLAVA REYES doesn’t guarantee the availability and continuity of the Web functioning and won’t be responsible for third-parties contents which might be stored under the Web. Therefore, ÁLAVA REYES will not be responsible in any way for any damages of any kind arising from (i) the lack of the Web availability or accessibility; (ii) the breaking of the Web functioning, computer, telephone or connection failures, delays or blackouts caused by overloads or deficiencies caused in telephone lines, data centres, Internet system or any other electronic systems while using it; and (iii) any other damages that might be caused by third parties by means of unauthorized interference beyond ÁLAVA REYES control.

To reduce the risk of computer virus introduction, ÁLAVA REYES uses virus scanners to control all the Contents introduced in the Web. However, ÁLAVA REYES doesn’t guarantee the absence of virus or other elements in the Web introduced by third parties outside ÁLAVA REYES that might cause alterations in the users’ hardware and software systems or any electronic documents or files stored in their system. Therefore, ÁLAVA REYES won’t be responsible in any case of any damages of any nature derived of the presence of virus or other elements capable of causing alterations in the users’ software, hardware, electronic documents or files.

ÁLAVA REYES takes different protection measures to protect the Web and its Contents against cyber attacks from third parties. However, ÁLAVA REYES doesn’t guarantee that unauthorized third parties won’t be able to know the websites you visit, or the conditions, features and circumstances in which you visit the Web. Therefore, ÁLAVA REYES won’t be responsible of the consequential damages derived from such unauthorized access.

ÁLAVA REYES can change terms and conditions established hereby, totally or partially, publishing any change in the same way this Legal Notice is communicated. The temporary duration of this Legal Notice is the same, therefore, as the period of time it is exhibited, until it’s modified totally or partially, moment in which the modified Legal Notice will be effective. It is advisable for the Users to read carefully this Legal Notice every time they get into the Web.

Applicable Law and Competent Court

The present Legal Notice and the relationship you have with ÁLAVA REYES will be subject to and interpreted in accordance to Spanish law. The parties agree to submit to the jurisdiction and authority of the Courts and Tribunals of the city of Madrid (Spain), notwithstanding that might be applicable another compulsory legal requirement, in which case they will submit to the same.
